Vets upset with court overturning lying law

FAYETTEVILLE, N.C.?? Jack Jacobs can proudly ? and truthfully ? say he was awarded the Medal of Honor for his valor in Vietnam. After a recent Supreme Court ruling, anyone else is free under the First Amendment to make the same claim, whether it's true or not.

Some military veterans say they consider the ruling a slap in the face. For Jacobs, though, it was the right decision. He said he wore the uniform to protect people's rights ? even if he doesn't agree with how they exercise those rights.

"There are lots of things people do that revolt me, but I'm happy that I fought for this country not to give them the right to do something stupid, but for the majority of the people to do the right thing," said Jacobs, 66, who earned the Medal of Honor in 1969 for carrying several of his buddies to safety from a shelled rice field despite the shrapnel wounds in his head, the streaming blood clouding his vision.

"I'm a free speech guy," he said.

The high court ruled 6-3 on Thursday to toss out the conviction of Xavier Alvarez, a former California politician who lied about being a decorated military veteran. He had been charged under the 2006 Stolen Valor Act, which made it a crime to lie about receiving the Medal of Honor and other prestigious military recognitions. The decision invalidated the law, as the justices ruled Alvarez's fabricated story was constitutionally protected speech.

For 87-year-old Murel Winans, lies about service can cause real harm and lead people to doubt the veracity of claims made by people who actually served during wartime. He said he didn't buy the free speech argument.

"You feel like you never earned it, because when you tell someone what you've done, they'll say, 'you're lying just like those other guys,'" said Winans, 87, who described himself as a "fresh young hillbilly from West Virginia" when he landed on Normandy's Omaha Beach on June 6, 1944 ? his 19th birthday.

The law was inspired by the 1998 book "Stolen Valor" by B.G. "Jug" Burkett, a Vietnam veteran. The government had argued the law was a needed tool to protect the integrity of military medals.

The ruling was issued the same day as the high court's landmark decision upholding President Barack Obama's signature health care overhaul. While much of the nation watched with rapt focus on what would become of the law that requires every American to have health insurance, many people in military communities were more focused on the ruling on the Stolen Valor Act.

Supreme Court strikes down Stolen Valor Act

Emotions ran high in Fayetteville, home to the 251-square-mile Fort Bragg. About 38 percent of North Carolina's population is either currently in the service, a veteran or a dependent of one, according to the N.C. Department of Administration. The state is also home to the sprawling Camp Lejeune, known for its training in amphibious assaults like the one at Normandy.

"My boys are out there giving their heart and soul," said Rose Moore, whose son is stationed in Afghanistan. "To have someone say they did it and they didn't do anything ? it's a lie, it's dishonest."

Army Capt. Albert Bryant acknowledged that he was disappointed, saying the lies can detract from people who earn something like the Medal of Honor. However, his disappointment was somewhat tempered.

"I know it's the First Amendment, but maybe you need to have an amendment to the amendment to protect our enlisted men and women," Bryant said. "Very few things in life are black and white so you have to take certain things in context, but there has to be some kind of common sense applied."

The decision doesn't give anyone carte blanche to lie about their service record in an effort to get free perks, however. Anyone who fabricates any honors can still face fraud charges, which is what happened to former Marine Sgt. David Budwah in 2009. He was demoted to private and dishonorably discharged after pretending to be a wounded war hero to get free seats at rock concerts and sports events.

Twenty-year Army veteran Raymond Hunt said the justices made the right move in protecting free speech. He said it's enough that Alvarez has been publicly shamed.

"For the rest of his life he has to walk around with that look on his face and know that he was the biggest liar in the country on something that is so sensitive to our country," Hunt said.

Retired Army Lt. Hal Fritz said the court treated those medals as something abstract. But for him, it's a memory.

Fritz was leading a seven-vehicle armored column down a Vietnam highway in 1969 when enemy combatants launched a surprise attack from all sides. Fritz was seriously wounded in the crossfire, but ran through the machine gun blasts to rally his troops. After his platoon survived the first wave, Fritz charged into a second enemy advancement armed with only a pistol and a bayonet. He was seriously wounded, but refused medical attention until all of his men had been cared for. He was awarded the Medal of Honor in 1971.

"We would disagree with the majority saying lying about receiving the medals doesn't devalue them," said Fritz, 68, who now lives in Illinois. "I would say go back with me to Vietnam dragging the dead and dying off the battlefield."

The Medal of Honor is among the rarest of honors: Only 81 of the 3,457 recipients since the Civil War are still living. Of those, only three are younger than 35, according to the Congressional Medal of Honor Society.

Of those interviewed, the Medal of Honor recipients agreed that Congress should try again to pass a similar law that would survive judicial scrutiny. That didn't ease the anger of people like Vietnam veteran Richard A. Pittman, who was awarded the Medal of Honor in 1968.

He had left his platoon to help Marines under fire, exhausting several machine guns before hurling his final weapon at the enemy: a grenade. His actions halted the Vietnamese advancement and bought time that saved many of his wounded companions.

"I'm supportive of the Constitution, but in this case I just think they're wrong," said Pittman, 68, who now lives in California. "I wonder what the Supreme Court would think if part of my resume said I was a member of the Supreme Court or I answered my phone 'Justice Pittman.'"

New research center in Madagascar opens today

Today, renowned primatologist Dr. Patricia Wright, and the Prime Minister and the Minister of Higher Education of Madagascar will unveil and open NamanaBe Hall (which translates as Friendship Hall) ? a new research, arts and community outreach building in Ranomafana, Madagascar.

The 1,440 square meter building is as ?green? as can be ? built out of local materials (locally-sourced granite, brick, and eucalyptus flooring), with work by local artisans and craftsmen, it has gardens and solar panels on the roof, gray water recycling, solar hot water, natural cooling, and enhanced use of daylight. Apart from it being sustainable, it is also hoped to provide an example to local (and global) populations on how to employ ?green? techniques in building design and construction.

NamanaBe Hall is the newest addition to Stony Brook University?s research center ? Centre ValBio ? built in 2003 to help indigenous people and the international community with conservation in Madagascar. It is a center of research in biodiversity, and also a community center for arts, environmental outreach, conservation education, and economic development of the region of the Ranomafana National Park. With the addition of NamanaBe Hall, Centre ValBio will become the largest, most modern, and most important research hub in Madagascar.

During the opening ceremony, the founder of the Centre ValBio, Dr. Patricia Wright will receive a Commander National Medal of Honor.

A world-renowned primatologist, Dr. Wright is a McArthur Genius Fellow and will now be the first recepient of all three major medals that Malagasy government can give. The first is the Chevalier Medal of Honor. To get this high honor one must have done exceptional deeds in one?s field. If one accomplishes a second exceptional deed or work one can receive the Officier Medal eight to ten years after the Chevaliar. The third medal, the Commander, can only be awarded five years after the Officier and denotes a person who has done honorable and exceptional work throughout their careers.

The Medals of Honor are awarded to person?s of high achievement, who are creative and have contributed exceptionally to the country of Madagascar. Dr. Wright will now be the first recipient of all three, for her 26 years of conservation work to advance Malagasy biodiversity. Grammy-award winning Malagasy brand Tarika Be (voted by Time Magazine as one of the ?10 Best Bands in the World? alongside U2 and Radiohead) will perform at the inauguration.

Residents tour Colorado blaze devastation

COLORADO SPRINGS, Colo. (AP) ? Melted bowling balls in the front yard were among the strange sights that met C.J. Moore upon her return Sunday to her two-story home, now reduced to ashes by the worst wildfire in Colorado history.

"Which is just hysterical. You wouldn't think bowling balls would melt," she told the Associated Press by phone from the scene in her Mountain Shadows neighborhood.

Moore was one of many residents allowed temporary visits to the most devastated of the area's neighborhoods. Almost 350 homes burned to the ground last week in the Waldo Canyon fire, one of many still raging across the West.

A line of cars a mile long queued up at a middle school checkpoint, where police checked the identification of returning residents and handed them water bottles.

While searching for her great-grandmother's cast-iron skillets, Moore marveled at the juxtaposition of what burned and what hadn't. She found stainless steel kitchenware, a vase lamp, a concrete frog.

"To find my mail in my mailbox, unscathed. It's just unreal. Unreal," she said. "Bird baths are fine. Some of the foliage is fine."

Three neighbors' homes were unscathed. Only concrete remained of other homes, including hers. Cars were burned to nothing but charred metal.

"Good lord! I've never seen anything like this. And thank God there was nobody there. Thank God there were no people here. There would have been no been no hope."

About 10,000 people remain evacuated, down from more than 30,000 at the peak of the Waldo Canyon fire, but authorities said Sunday morning they hoped to lift more evacuation orders later in the day.

The 26-square-mile fire was 45 percent contained as of Sunday morning. It was one of many burning across the West.

Rich Harvey, incident commander, said crews continue to make good progress.

"We're cautiously optimistic," he said Sunday morning. "We still remain focused on things that could go wrong."

About 1,500 personnel were fighting the Waldo Canyon fire, and authorities said they were confident they had built good fire lines in many areas to stop flames from spreading.

Authorities are still trying to determine the cause of the fire that broke out on June 23, and which so far has cost $8.8 million to battle. Dangerous conditions had kept them from beginning their inquiry, but investigators were able to start their work on Saturday.

Two bodies were found in the ruins of one house, one of almost 350 destroyed in this city 60 miles south of Denver. The victims' names haven't been released. Police Chief Pete Carey said Saturday afternoon the approximately 10 people who had been unaccounted for had now been located.

Police did not expect to discover other victims in the rubble.

More than 150 National Guard soldiers and airmen helped Colorado Springs police staff roadblocks and patrol streets.

A "bear invasion" confronted a few mountain enclaves west of Colorado Springs. The scent of trash had enticed black bears pushed out of their usual forest habitat by fire.

People who left in a hurry didn't take typical precautions to secure household trash against wildlife, said El Paso County Sheriff's Lt. Jeff Kramer.

"It's been sitting there for, well, approximately a week now. So that's become an attraction for the bears," Kramer said.

State game officials were trying to shoo the bears out, he said, and Dumpsters were stationed to help volunteers and returning homeowners throw stuff out.

Kramer said he didn't know how many bears were causing problems.

Among the fires elsewhere in the West:

? Utah: Fire commanders say Utah's largest wildfire has consumed more than 150 square miles and shows no sign of burning itself out. Hundreds of firefighters are trying to hold the Clay Springs fire from advancing on the ranching towns of Scipio and Mills on the edge of Utah's west desert. The fire has destroyed one summer home and threatens 75 others. The fire was 48 percent contained on Sunday.

? Montana: Authorities in eastern Montana ordered the evacuation of several communities Saturday as the Ash Creek Complex fires, which has burned more than 70 homes this week, consumed another 72 square miles. The blaze grew to 244 square miles overnight.

? Wyoming: A wind-driven wildfire in a sparsely populated area of southeastern Wyoming exploded from eight square miles to nearly 58 square miles in a single day, and an unknown number of structures have burned. About 200 structures were considered threatened.

? Idaho: A fast-moving 1,000-acre wildfire in eastern Idaho that destroyed 66 homes and 29 outbuildings was expected to be contained Saturday. Some 1,000 residents were evacuated; it was unclear when they would be allowed back.

? Colorado: The last evacuees from the High Park Fire in northern Colorado have been allowed to return home as crews fully contained the blaze. The 136-square-mile fire killed one resident and destroyed 259 houses, a state record until the fire near Colorado Springs destroyed 346 homes.
