VinePeek And VineRoulette Let Us Become Real-time Video Voyeurs

Screen Shot 2013-01-27 at 10.51.59 AMTwitter's new video-sharing service, Vine, launched a few days ago, which we've covered extensively. My main complaint after a couple days worth of use is that I simply can't find enough vines to enjoy. But a "Friday project" out of product incubator PXi Ventures could change all that, as they've launched a service called VinePeek.

It is the most common cancer affecting men, and some experts predict it will become the most common cancer across the sexes by 2030.

But it lies 20th in a table of annual cancer research spend per case diagnosed.

Figures from the charity show that breast cancer ? the most common female cancer which has a similar death rate as prostate cancer ? received more than double the annual research spend.

The Sledgehammer Fund will operate until the end of March, and aims to generate cash to help Prostate Cancer UK find answers by funding research, providing information and raising the profile of the disease.

Bailey, 47, is appearing in a series of television, digital and print adverts.

He said: "Blokes are not always good at taking care of themselves and, even if they know they have a health problem, they often don't want to talk about it ? or they just hope it will go away.

"I want The Sledgehammer Fund to help change that. I hope the advert that I've made for Prostate Cancer UK will get men talking about prostate cancer and their prostates. The charity wants to raise more money for research because there's a need for better treatments and better ways of diagnosing prostate cancer ? so the deadlier tumours are caught, before it's too late.

"To quote myself from the ad, do yourself a favour, do your dad a favour, do your son a favour, do mankind a favour ? and get giving."

People are being urged to donate ?5 to the fund by texting CRACK to 70004, visiting prostatecanceruk.org or calling 0800 082 1199.

Illinois workers' compensation - don't give a recorded statement

A reader asks:

I fell on a tarp that was covering carpet at my office. It was there for construction and as I fell I grabbed the railing and felt a terrible pain in my shoulder. My doctor thinks that I tore my rotator cuff and wants me to get a MRI. The insurance adjuster told me that she will not authorize any treatment until I give a recorded statement about what happened. Should I do this?

The answer is always NO. Even in a case like this where the injured worker is clearly hurt on the job, recorded statements exist for only one reason. It gives an insurance adjuster a chance to twist your words against you. Insurance companies make money by not paying out claims that they should pay out. So in a case like this, if the adjuster can get the worker to state that they really aren?t 100% sure why they fell, that would be enough to deny the claim and potentially save the insurance company tens of thousands in medical bills they don?t have to pay.

In a case like this, we call the insurance adjusters and tell them that our client will not be giving a recorded statement. We will answer any questions the adjuster has. Anything we say can not be used as evidence. Anything you say, even if it gets twisted, can be used against you in an arbitration hearing or to deny your benefits.

No one would assume that an insurance company has bad intentions by asking what happened in the accident (or maybe they would assume that), but there is no reason they take these statements other than to try to come up with a reason to deny you.

So don?t talk. It can?t help you, even if you are honest. And remember, your benefits can?t legally be denied for not talking and if they are denied there are things we can do to turn the case around while still protecting your rights.

We are workers' compensation attorneys who help people with Illinois work injuries anywhere in IL via our statewide network of attorneys.?Contact us?and we will answer your questions or find the right lawyer for your situation.

HCH051 Quitting Smoking Before Cancer Surgery Best, Study Finds

FRIDAY, Jan. 25 (HealthDay News) ? Cancer patients who smoked up until their surgery were more likely to take up the habit again compared to those who quit earlier, a new study finds.

The study from the Moffitt Cancer Center in Tampa, Fla., included lung cancer and head and neck cancer patients who quit smoking before or immediately after surgery. They were followed for a year after the surgery.

?Sixty percent of patients who smoked during the week prior to surgery resumed smoking afterward, contrasted with a 13 percent relapse rate for those who had quit smoking prior to surgery,? study corresponding author Vani Nath Simmons said in a Moffitt news release.

The significantly lower smoking relapse rate for those who quit smoking before surgery shows the need to encourage patients to quit smoking when they?re diagnosed with cancer, the researchers said.

The investigators also noted that most of the patients who began smoking again did so shortly after surgery, which shows the importance of anti-smoking programs for patients both before and after surgery.

The study also found that patients were more likely to resume smoking if they had a high amount of fear about cancer recurrence, had a higher risk for depression, and were less likely to believe in their ability to quit smoking.

?Cancer patients need to know that it?s never too late to quit,? Simmons said. ?Of course, it would be best if they quit smoking before getting cancer; but barring that, they should quit as soon as they get diagnosed. And with a little assistance, there is no reason that they can?t succeed.?

Woman sues Match.com for $10M after attack

22 hrs.

A Las Vegas woman who was severely beaten by a man she met through Match.com is suing the online dating site for $10 million?two years and multiple surgeries after the attack that left her hospitalized for months.

The woman, Mary Kay Beckman, was stabbed multiple times with a butcher knife on Jan. 21, 2011?by?Wade Mitchell Ridley, and when?the knife broke, he stomped on her head. Ridley, who was sentenced to?28 to 70 years,?died in prison last year. He was also facing a murder charge in Arizona for the stabbing death of a former girlfriend a few weeks after the attack on Beckman.

Beckman filed suit in Clark County, Nevada,?accusing Match.com of negligence, negligent misrepresentation, deceptive trade, failure to warn and negligent infliction of emotional distress.

The site, she said, failed to warn her about the dangers of meeting "an individual whose intentions are not to find a mate, but to find victims to kill or rape."

The real estate agent said she joined Match.com about a month before her first in-person meeting with Ridley on Sept. 26, 2010. They dated for 10 days, but she called it off. That's when Ridley started sending her threatening and harassing messages.?

On Jan. 21, 2011, Ridley attacked Beckman in her garage, and left her for dead, she says, when she stopped making a "gurgling noise."?

Beckman, now 50, continues to recover and to speak out against online dating?"I do not believe that online dating is a safe venue for men or women,"?she?recently?told?a?local?FOX?TV?reporter.

Match.com, in a statement to NBC News Friday, said that what happened to Beckman "is horrible, but this lawsuit is absurd.?The many millions of people who have found love on Match.com and other online dating sites know how fulfilling it is. And while that doesn't make what happened in this case any less awful, this is about a sick, twisted individual with no prior criminal record, not an entire community of men and women looking to meet each other."

Safety, the site said, "is very important to Match," which, like many other online dating sites, includes online and offline tips for staying safe.

In California, Match.com and two other dating sites, eHarmony and Spark Networks, signed a joint statement of business principles, agreeing to screen for sex offenders and take other safety steps after a woman was assaulted on a date, the state attorney general's office said last March.?

The joint statement ?was prompted by the 2010 sexual assault of a Los Angeles-area woman by a man she met through Match.com, a spokeswoman for the state attorney general's office said. The woman sued Match.com, seeking a court order requiring the site to check applicants' backgrounds to weed out convicted sex offenders. She dropped the suit after the site provided proof of such screening.

Meanwhile, in the last two years, friends and work associates of Beckman have held fundraisers for her, including one last year, with information shared about it on YouTube (see video below).

Are You A Buying Customer Or A Buying Client? | North Georgia ...

said on January 25th, 2013 filed under: Buyer Advice, Real Estate

I really enjoy coaching recreational sports, especially my own children. I have to tell you, it can be trying at times. Let me sum it up like this. There are players, and then there are players. Often times we refer to the ?players? as ?gamers!? That is why they have All-Stars, I am certain of it.

    The Buyer Agency Agreement

Buyer AgencyLikewise, there are agents, and then there are agents. However you must be careful, the term ?agent? can represent two totally different relationships when buying a cabin or mountain home for sale here in the North Georgia Real Estate Market.

The term ?agent?? is typically reserved for someone with whom you have established an agency relationship with. Until such a relationship is established, you are a customer and an agent (in the casual sense) may not have your best interests in mind. An agency relationship is created in writing, and the terms of that agency relationship are defined within that Exclusive Buyer Brokerage Agreement. Once this agency relationship is established, the then true agent now has certain fiduciary responsibilities to the client. We will look at those in just a minute, but now an agent does indeed represent your best interest in a real estate transaction.

Agent requirements also include the following:

    • Loyalty
    • Obedience
    • Disclosure
    • Confidentiality
    • Reasonable Care and Diligence
    • Accounting

    Determine The Relationship

It is vitally important that you determine the relationship with your ?agent? early in your working relationship. You may want to consult with the Georgia Association of Realtors?to gain a better understanding about agency laws here in Georgia. You may also seek additional information from the Georgia Real Estate Commission as well.

Below you will find some details on how your status may effect the level of service you are entitled to in each relationship.

If you are a Customer with No Agency relationship and agent will:

    • Maintain loyalty to the seller?s need
    • Tell the seller all that they know about you
    • Keep information about the seller confidential
    • Focus on the seller-client?s property
    • Provide just material facts only
    • Only provide price information that supports the seller?s listing price
    • Protect the seller
    • Negotiate on behalf of the seller
    • Attempt to solve problems to the seller?s advantage and satisfaction

If you are a Client with an Agency Relationship an agent will:

    • Pay Full attention to your needs
    • Tell you what they know about the seller
    • Keep information about you confidential
    • Focus on choices that satisfy your needs
    • Provide and research material facts as well as professional advice
    • Provide price counseling based on comparable properties and their professional insights
    • Protect and guide you at all times
    • Negotiate on your behalf
    • Attempt to solve problems to your advantage and satisfaction
*This is for general illustrations. Agency laws vary by state; and specific terms of individual agency will also vary from one agent to another.*

    Questions For Your Agent?

    1. Do you represent buyers, sellers or both?
    2. What services are provided to (or excluded from) me, based on my status as a buyer-customer or buyer-client?
    3. When does representation begin? When does it conclude?
    4. If I?m not ready to commit to your normal term, can you offer me a one-day buyer agency agreement or a 24-hour opt-out clause?
    5. How is dual agency addressed in your firm?

The Mountain Life Team believes that no party to a transaction should go unrepresented, especially Buyers. We are Professional Realtors? and currently we have 4 Buyer Specialist? on our team that are focused on keeping the Buyer?s best interest in mind at all times. Our Buyer Specialist do not represent our Listing Clients. Please Contact Us to setup a consultation with one of our agents today, or if you have any questions or concerns with Buyer Agency Relationships.

How Budgeting Can Help Improve Your Life In Different Ways

How Budgeting Can Help Improve Your Life In Different Ways

    improveyourbudgeting

Many of us don?t know that budgeting is a life-changing tool.?Understanding?how a budget can help with your finances is the first step to making a life change when it comes to your money.

How budgeting can help improve your life in different ways

We all are aware of the proverb ?ignorance is bliss?. However, this is not always true. There are certain areas in our daily life which should not be ignored at any cost, and budgeting is one such area. When you live without a budget, the situation can be analogized with traveling on a ship without a rudder. The key to having a successful budget is to be honest and frank about your financial circumstances and lowering your spending. A sensible budget can serve various purposes and you can benefit from it in different ways. Many of us don?t understand that budgeting is one of the best tools we can use to fulfill our financial goals.

What do you need for setting a realistic budget?

Remember that your budget has to be precise otherwise it will not be effective. You will need certain important details for designing a reasonable and precise budget and you need to devote considerable time for that.
    1) Day to day record of your spending
For keeping this record, you have to retain all the bills and receipts of your shopping. Also assemble your bank statements for the past three months. You will get an idea about where your money is flowing out, for example mortgage loan payment, rent, insurance, credit cards, and utility bills.
    2) Details of your earning
Make a list of all the sources of your income such as your salary, other financial allowances or benefits, and interest earned from investments.
    3) Details of your saving or investment
Information about any saving that you do on a regular basis or any investment.
    4) List of your annual expenses
Listing your annual expenses is also crucial in designing a sensible budget. You can list your yearly healthcare costs, automobile licensing, vacationing and gift expenses over here.
As soon as you have devised the budget, you need to keep track of your spending by using an online widget or by maintaining a diary.
What are the benefits of a budget??Given below are the benefits offered by a sensible budget if it is followed sincerely:

    • A budget allows you to regulate your money rather than your money regulating you.
    • A budget helps you attain your financial objectives. It also protects you from becoming digressed.
    • It can help you achieve your savings objectives.
    • It can inform you whether you are living within your means.
    • It helps your whole family concentrate on familiar responsibilities.
    • If you sincerely follow a practical budget, it generates surplus cash.
    • A budget can better your marriage or personal relationship with your partner.
    • A budget helps you get ready for unforeseen circumstances.
    • A budget can help you become debt free and stay away from debt.
    • A budget shows sectors where you?re spending excessive money or wasting money.
    • A budget essentially generates additional funds.
    • It helps you become a prudent shopper and a better personal finance manager
    • A good budget helps you get peace of mind.

Creating a sensible budget might take some time and following it diligently is also a matter of time. However, it will always pay off and you will see the positive outcomes in every sphere of your life.

Rugby: Game slammed as 'last bastion of chauvinism' | Otago Daily ...

Rugby, a blokey sport rife with misogyny?

New Zealand's national sport has been lambasted as a sexist institution and the "last bastion of chauvinism" after a report found women were excluded from decision-making at all levels of the game.

The NZRU has never had a female voice at the boardroom table, while of 194 board positions at provincial level, just five (two of which are on the Auckland Rugby Board) are taken by women.

The glaring imbalance prompted Dr Judy McGregor, in her former role at the Human Rights Commission, to launch a campaign late last year pushing for the inclusion of a female representative on the NZRU board.

Asked if rugby was an inherently sexist establishment, Dr McGregor replied: "Absolutely. The figures show it. When you have absolutely no women involved in the decision-making ... despite the fact women hold many rugby clubs together, it shows there is a big problem. I honestly can't believe it - the numbers are deplorable."

McGregor, who authored the 2012 census report into women's participation, found that generally national sporting organisations are getting their act together when it comes to female representation on boards.

Data gathered over the past decade shows the number of sports that have women in governance positions is slowly but surely improving.

But rugby is one of three "recalcitrant sports" - the other two being shooting and curling - that do not have any females on their national board.

Given the profile rugby enjoys in this country, McGregor said she felt compelled to single out the NZRU.

"Sports governance is a critical area for female representation - given its significance to our national identity, rugby should be a leader, not the last bastion of chauvinism.

"I think at all levels there needs to be reform and change."

The criticism of the NZRU comes when many sporting organisations are making a point of ensuring women are more visible in their game. In Australia, the NRL has an annual "women in league" round aimed at celebrating the achievements and growth of female involvement in their sport, while at the same time encouraging those in the game to push even harder to break new barriers.

The initiative has helped improve the competition's image from that of being a blokey sport rife with misogyny, to one which is more inclusive - although the ploy will continue to look like tokenism while unsavoury incidents involving some of the game's stars and women continue.

Former Black Fern Louisa Wall said the NZRU has been slow to recognise the value female leaders can bring to their game.

"Women are a huge contributor to rugby in New Zealand. It's not just the playing base, but it's the business of rugby. There were just as many women at the Rugby World Cup final as men," said Wall, Labour's spokeswoman for sport and recreation.

"The NZRU don't seem to have caught up with the fact that women watch rugby, they play the game, they buy All Blacks jerseys - it's our national sport."

Wall has twice put her name forward for top rugby governance positions.

She applied for one of the independent seats on the NZRU board, and more recently tried for a position on the Blues board - "I didn't even get an interview for the Blues board, it's such an old boys' network."

As director on the Maori Rugby board, Wall's former teammate, Farah Palmer, is one of the few women that have any say in the strategic direction of the game. Palmer said the way rugby's constitution is structured, the only avenue females have of forcing their way into the NZRU boardroom is through their two independent seats.

"It's very difficult for women to get on to the [national] board, because you have to be on a provincial rugby union board, and then you have to be nominated by predominantly men who have been involved in rugby and know one another from their playing days.

"So the pathways to get on to those boards is limiting for women," said Palmer.

Since 2007, the NZRU has sought applications for five independent directorship terms but despite receiving 24 applications from women over that time, none were successful.

NZRU chairman Mike Eagle was unavailable for an interview for the series, but in a statement he acknowledged the fact they had no gender diversity on the board "is an issue for us".

Eagle said the profile of the women's game was increasing with the inclusion of sevens rugby in the Olympic programme, which he believed would lead to more women putting their hands up for leadership roles.

"As participation increases, we hope, and expect, more women will want to be involved off the field, including in governance roles, as has happened with other sports," he said.

McGregor believes the NZRU needs to follow the lead from league and cricket and be more proactive about involving women.

It was not enough for the NZRU to change its constitution to allow for greater diversity if it was not going to result in any real change.

"Contemporary organisations have contemporary boards, and if you continue to have an entirely all-male rugby board, that is saying something to the world."

Apple pulls 500px photo app over nudity concerns

    12 hrs.

Apple has pulled two popular photography apps from the iOS app store, reportedly because the company found it too easy to find nude images ? though, notably, not pornographic ones. 500px, whose apps were removed, is resubmitting them with adjustments, but Apple is already being criticized for this seemingly arbitrary policy.

The apps were taken down Tuesday morning, following discussions between 500px and Apple relating to a new version of the app. With nearly a million downloads at the time of the takedown, 500px's main app was a popular way to share photos online ? and not not a new one, either. The version Apple removed was functionally much the same as the one approved back?in October of 2011.

500px cofounder Evgeny Tchebotarev told TechCrunch that an Apple reviewer rejected their proposed update on the grounds that it let users search for nude photos. In fact, the app defaults to a safe search mode that can only be disabled via the main website.

Furthermore, the nude photos that one might search for are of the art variety, not porn. "We don?t allow pornographic images. If something is purely pornographic, it?s against our terms and it?s deleted," Tchebotarev?said.

On Twitter and at various blogs and news websites, Apple came under fire almost immediately. Among others, the company's?own Safari Web browser app can be used to find explicit images extremely easily.

It's not the first time Apple has been attacked for what people view as its Puritanical restrictions on apps. Web browsers in the app store are age-restricted because they could be used to find adult material, and the company has also removed what it feels are adult titles from its bookstore, prompting widespread criticism.

Tchebotarev took to Twitter to say that his company is hoping to get its?iOS app back online soon, presumably after some Apple-suggested adjustments have been made.

UPDATE 5:21PM: An Apple representative tells GigaOM that there were complaints of child pornography, although the CEO denies this was mentioned to them:

"The app was removed from the App Store for featuring pornographic images and material, a clear violation of our guidelines. We also received customer complaints about possible child pornography."

Fuel Fix ? Some signed low-rent drilling leases

A crew works on a drilling rig at a well site for shale based natural gas in Zelienople, Pa. (AP Photo/Keith Srakocic)

OAKLAND, Md. ? The land men came one evening in 2006, offering property owners modest riches for a simple act: leasing their land rights to the natural gas industry?s middlemen.

Carl W. Lohr, a farmer in Friendsville, didn?t sign that night. But when the land men from the Lexington, Ky.-based Keeton Group LLC came knocking at his door weeks later, he leased his 156 acres to the company for five years, at $5 per acre, in return for allowing gas wells to be drilled using a controversial practice called hydraulic fracturing, or fracking.

At $5 an acre, Lohr is cut a check every year for less than $800. He?s happy with that amount, which he said is enough to cover real estate taxes in Garrett County. But other land owners, as close at hand as Pennsylvania, have signed leases for up to $6,000 per acre. And natural gas industry members and experts say it?s fairly common for some land men to sign property owners to a lowball lease and then resell the rights to energy companies for a big profit.

A commission formed by Gov. Martin O?Malley in 2011 to study fracking practices and safety agreed this week to recommend that legislation be introduced in the General Assembly to force land men to register with the state. This year?s session begins Wednesday.

    ____

    The Pennsylvania experience

Jon Laughner, an extension educator with Pennsylvania State University?s College of Agricultural Sciences, said Maryland?s experience isn?t unique. He has tried to educate Pennsylvania residents about how some land men do business for years.

?Their goal is to accumulate a lot of land leases in an area and then flip them, sell them to the energy companies,? said Laughner, who has studied hundreds of leases in Pennsylvania, where there are far more natural gas deposits than in Maryland.

A man who answered the phone at The Keeton Group?s office declined to answer questions about the company?s leasing practices. Keeton persuaded hundreds of Garrett County residents to sign land leases starting in 2006, but the company is not alone in the complicated world of energy company land leases.

Land men ? sometimes brokers, sometimes contractors and sometimes direct employees of gas companies ? first descended in 2006 on Western Maryland, where the Marcellus Shale rock formation runs a mile below the surface. At that point, residents in Garrett and Allegany counties didn?t know what they had beneath them.

The Marcellus Shale formation is a rock-encased deposit of natural gas that can be extracted through a complicated process that involves drilling a mile deep and blasting a water and chemical mixture into the rock, fracturing it and releasing gas.

Companies that employ land men generally don?t have the wherewithal to actually extract the gas. They make their money by finalizing real estate deals, then selling groups of leases to natural gas exploration and production companies at a profit.

    ____

    ?Good and valuable consideration?

Laughner said energy companies and land men keep the details of their transactions secret, treating them as proprietary information. The sale of land leases can be tracked from company to company, but the purchase amount is usually described in court documents only as ?good and valuable consideration.?

Such is the case with Lohr?s lease, which from 2006 to 2010 changed hands from Keeton, to Unconventionals I LLC, to Chief Exploration & Development LLC and Radler 2000 Limited Partnership and finally to Chevron U.S.A. Inc., which bought the leasing rights to Lohr?s 156 acres and dozens of other lease agreements in July 2010.

Delmer R. Yoder, a 76-year-old farmer in Accident, said he didn?t sign with the land men when they came to Garrett County in 2006. Instead, he did some research.

What he found was that land owners in areas of the country that were already leasing property to gas companies were making far more money than the land men were offering Maryland residents. According to several people familiar with land leasing, the lease amount has been up to $6,000 per acre in Pennsylvania, West Virginia and elsewhere, with royalties on extracted natural gas reaching up to 18 percent.

?I started looking into this thing and calling different places around,? Yoder said. ?Come to find out that we could do better.?

Yoder started a group that quickly swelled to more than 200 county residents who wanted to lease their land. Yoder hired a consultant and negotiated a fee of $1,150 per acre.

    ____

    Prices may vary

Lohr, who was among the first Western Marylanders to sign with the land men, said most of his neighbors followed suit. Some made out a little better than he did, garnering up to $15 an acre, but he said he was shocked to hear that the land he leased may be worth so much more.

At the price Yoder?s group had negotiated, Lohr?s payment of $780 per year would have swelled to $179,400.

?I had already signed up before he really created that group,? Lohr said.

But he was also grateful for the money he got. The recession and an executive order signed by O?Malley imposing a moratorium on fracking until 2014 have virtually halted all leasing activity, temporarily derailing the agreement reached by Yoder?s group.

The Daily Record reported in September that some gas companies were letting five-year leases expire having never drilled even a foot into the ground.

    ____

    ?Cattle sale?

Lohr said he?s not upset with the land men who signed him up for $5 an acre. There was no arm twisting, he said, and he was happy for the extra money.

?It?s like a cattle sale,? Lohr said. ?Sometimes you?d get top dollar, and sometimes you didn?t. But I wish they would drill.?

Delvin E. Mast, a dairy farmer in Grantsville, was less forgiving. He said he signed with Samson Resources Co. for a relatively robust $25 an acre in 2007, but was disappointed when he learned the real value of his land. Mast said his lease has expired, which is fine by him ? he?s joining Yoder?s group, he said, and putting his 500 acres on the auction block.

?I?m not really disappointed that the lease is terminating,? Mast told The Daily Record in September. ?But I do wish Maryland would get their act together.?

Laughner, who said early leases signed in Western Pennsylvania in 2005 and 2006 were usually for $5 to $10 an acre, said the college?s extension office was trying to make sure land owners didn?t make up their minds without knowing what was involved.

?When somebody showed up in 2005 or 2006 and said, ?We?d like to lease the land for $5 an acre,? it didn?t seem unusual. People have been doing it for decades,? Laughner said. ?They (thought they) knew there wasn?t any gas there, so take the $5 an acre and run.

?I suspect there was a little bit of knowledge (on the industry?s side) that there was a potential for these leases to be a lot more valuable than $5 an acre. But it was not apparent to the general public.?

    ____

    ?Nice pocketful of change?

That?s what Yoder said drove hundreds of land owners to sign for far less money than they should have.

?I?m sure they made a nice pocketful of change,? Yoder said of the land men who brokered many of the early deals. ?But I?m not blaming the people that signed in for $5 an acre. They didn?t know no better.?

Once people did know better, elected officials in Western Maryland started to search for ways to protect land owners.

It was Sen. George C. Edwards and Del. Wendell R. Beitzel, Republicans who exclusively represent the portion of the state that includes Marcellus Shale deposits, who introduced legislation last year that would have forced land men to pay a $100 fee and register with the state Department of Labor, Licensing and Regulation.

The bill would have provided a modicum of accountability, Edwards said ? an argument that has belatedly been recognized by the Marcellus Shale Safe Drilling Initiative Advisory Commission.

The Senate version of the 2012 bill, heard in the Education, Health and Environmental Affairs Committee on March 6, was relegated to a drawer by Sen. Joan Carter Conway, a Baltimore Democrat who chairs the committee and has not had her panel vote on several fracking-related bills in the last two legislative sessions.

Beitzel?s version of the bill was bounced from the House of Delegates? Environmental Matters Committee into the Economic Matters Committee, where it ultimately received an unfavorable report in late March, preventing it from being considered by the full chamber.

    ____

    Making it legit

Edwards, who wants fracking to happen in Western Maryland ? he sees economic benefits to it ? said the land men ought to be held accountable.

?We want to make sure they?re legitimate ? legitimate with the state, so people dealing with them know that,? Edwards said in a recent interview.

He noted there is a national group, the American Association of Professional Landmen, but pointed out that isn?t a regulatory body, just an organization whose members are held to a code of ethics. Section 1 of that code says land men should strive to treat land owners fairly. A call to the association was not returned.

Edwards said legislation also should consider including lease requirements, to ensure land owners are getting appropriate payments for allowing companies to drill. The commission has thus far balked at making such a recommendation.

?Should there be a minimum royalty and maybe the per-acre lease (should have a minimum)?? Edwards said, ticking off various lease components that ought to be discussed. ?Should there be other certain things in the lease??

Yoder said his group just wanted a fair deal. He?s frustrated that the state?s regulatory framework for fracking hasn?t been determined and that O?Malley?s moratorium has delayed his group?s ability to sign with a natural gas company.

?Right now, we?re just waiting to see what?s going to happen,? Yoder said. ?Right now, we can?t do anything. Once the gas companies can get leases and start drilling, I think I think we can probably regroup and go from there.?

But only if gas companies and their land men offer fair value for what lies beneath the surface of Western Maryland.

?It?s got to be a two-way street,? Yoder said. ?We got to make money, and so do the gas companies.?

Using a Home Equity Loan or Second Mortgage to Fund a Small ...

In basic terms, home equity loans are type of loan through which a person uses the equity in his or her home as collateral.

Equity represents the difference between the amount of any outstanding home mortgage loan and the appraised value of the residence. The lender obtains a lien on the real estate in the same manner as the original mortgage loan lender.

Typically, a home equity loan (also called a second mortgage) is used to obtain funds for home improvements, a child?s college education, to consolidate other debts and the like. The proceeds from a home equity loan can be utilized to fund a small business enterprise.

Funding a Small Business with a Home Equity Loan

The mechanics of funding a small business with a home equity loan are relatively simple. An application is made to a financial institution for a home equity loan or second mortgage. Provided a person has a consistent track record of making mortgage payments in a timely manner, and assuming a cushion in the form of equity remains after a home equity loan, a bank likely will agree to the financing proposal. In the end, under this set of circumstances, a financial institution is not entering into a risky loan agreement.

Once the loan is approved and funds dispersed, the money is then available to be transferred to the small business for its use.

Requirements for Obtaining a Home Equity Loan to Fund a Small Business

As noted previously, one of the essential requirements is a good track record of making the primary mortgage payments in a timely manner. In addition, a financial institution will want to verify that the borrower has a source of income, including possibly a source of income in addition to the small business for which funding is sought.

Keep in mind that if a small business owner is married, the spouse will need to be a party to the home equity loan, even if he or she is not directly involved in the operation of management of the small business.

The Propriety of Funding a Small Business with a Home Equity Loan

The reality is that in challenging economic times, more traditional and direct means of financing are not always readily available to small business. Some banks tend to be leery about lending money to a small venture, particularly a start-up business with no established track record.

Understanding these constraints, using a portion of the equity in a home to obtain a loan for a small business may make sense. A person is well advised not to use the entire equitable balance to secure a loan proceeds for a small business. Some type of personal or family emergency could arise necessitating the needs to tap into a home?s equity to obtain funds.

Tax Consequences of Using Funds from Home Equity Loan for a Small Business

The IRS permits a full deduction by the business for the payments it makes on the loan, despite the fact that the financing originated as a home equity loan or second mortgage. The loan payments are considered a legitimate business expense.

    Consult a Professional

On a final note, before transferring funds obtained from a home mortgage loan to a small business, consulting with a tax accountant or attorney is a crucial order of business. The transfer must be done in accordance with applicable federal and state laws, information which is available from a professional experienced in business and tax law as well as accounting.

ADHD rates soar in California, but why?

NEW YORK (Reuters Health) - More children are being diagnosed with attention deficit hyperactivity disorder (ADHD) now than were a decade ago, according to new research from a large California health plan.

It's not clear what's behind that trend, researchers noted. Possible explanations include better awareness of the condition among parents and doctors or improved access to health care for kids with symptoms, according to Dr. Darios Getahun, the study's lead author.

Prior research has also shown an increasing trend in ADHD diagnoses, according to Getahun, from the Kaiser Permanente Southern California Medical Group in Pasadena.

However, his team had strict criteria for determining which kids had ADHD, requiring a clinical diagnosis and prescriptions for ADHD medications. Past studies have relied on parent and teacher reports alone, Getahun noted.

In an analysis of Kaiser Permanente medical records, researchers found the proportion of five- to 11-year-olds diagnosed with ADHD increased from 2.5 percent in 2001 to 3.1 percent in 2010.

Consistent with past research, white children were more likely to be diagnosed with ADHD than black, Hispanic and Asian kids, and boys were more likely to have the condition than girls.

On average, children were diagnosed when they were between eight and a half and nine and a half years old. Hispanic youth tended to receive a diagnosis at a later age than other kids - which could put them at a disadvantage, Getahun noted.

"One thing which is very important in ADHD is parents' awareness... and timely diagnosis of the disease is very important so the treatment is effective," he told Reuters Health.

"If you diagnose the child early when the disease occurs, the child may function better in school and also socially," said Getahun.

One study published last year found Icelandic kids who got early ADHD treatment did better on standardized tests than those who didn't get medication until they were preteens (see Reuters Health story of June 25, 2012: http://reut.rs/KXoQfY).

Common medications used to treat ADHD include stimulants such as Vyvanse, Ritalin and Concerta.

Not all kids with ADHD need medication - some get better with behavioral therapy or extra help at school. ADHD drugs can come with side effects, including appetite loss, sleep problems and stomach aches.

Just under five percent of more than 840,000 kids were diagnosed with ADHD during the entire study period, the researchers wrote Monday in the journal JAMA Pediatrics.

Parental reports suggest that closer to one in ten kids and teens has been diagnosed with ADHD, according to the Centers for Disease Control and Prevention, and rates vary by state - from 5.6 percent of kids in Nevada to 15.6 percent of North Carolina youth.

Online Business 2013: EmpoweredEzine.com Reviews The Best ...

? /PRNewswire-iReach/ ? There are a number of different ideas for the types of business 2013 will bring. Many people speculate that there will be an increase in online businesses as well as people who are searching for ways to get out of their old jobs and become their own bosses. These two ideas go hand in hand for most people.

Starting an online business holds a lot of appeal for many people for a number of reasons. The foremost reason is possibly the conveniences of running a business from home. When a business is based online, the products or services can be marketed to a global audience, and the business owner can do all this from the comfort of their own home. They won?t need to drive to the office everyday; their office could literally be located right there in their bedroom.

Another reason that internet options are being sought out is because the low start up cost associated with starting a business online. Usually the initial investment is very minimal, and no where near as much as what could be expected when starting a conventional business. This benefit alone may prompt people to choose this option over others, as it may be the only type of business that a person is able to operate on the budget they have available to them.

The types of online businesses that can be started are endless. However there are a few good leads for those who want to start an online business in 2013. The first popular option is affiliate marketing. In this business model, the business focuses as the advertising arm of various businesses that offer products or services. Affiliate marketers can pick and choose which companies they will work with and what products they will promote.

What is so attractive about this business model is that the affiliate marketer does not need to worry about keeping an inventory or fulfilling customer requests or settling complaints. They simply need to market the products and they get a commission for every sale made as a result of their efforts. The rest is taken care of by the parent affiliate company.

This business is also very popular because it can results in the person earning a residual income. The way the internet works, it is possible to set up an advertising campaign, then once that campaign is in full swing and is drawing in leads and resulting in sales, the marketer can basically sit back and let the internet do the rest. This means that a person may still get commissions on work that was done months or even years ago.

In order to do this, a person would have to have a clear knowledge of how the online market place works, and have the skills needed to create and implement an effective online marketing campaign. People with marketing experience may have a head start when it comes to this, but there are many online programs that can teach even beginners how to use this business model to their advantage.

One of the best free online programs that people can make use of to this end is Internet Income University. This program teaches the basics, as well as more advanced techniques, and sign up for the program is completely free.

How to write a social media plan

Photo: Woman Writing in Journal Credit: Jan Willem Geertsma

Maybe you are already doing it, maybe you are thinking about doing it, either way you need to make sure you put together a sound social media plan for your business. There are many reasons to join social media. Two-thirds of the global internet population are on social networks like Facebook and Twitter. Facebook alone has 400 million users. Twitter, with its population of 110 million users is adding 300,000 users a day! Who?wouldn?t?want to tap into that traffic?

    Where to start?

First think about what you want to accomplish in social media: build brand awareness, interact with your customers, understand buyer wants and needs, improve customer service, gain insight for new products, increase your website traffic, build search engine rankings, drive traffic to events or generate sales leads. Each of these goals are plausible for social media, so choose those important to you and your company and design your approach around that end goal. Make sure you have a measurement for your plan. For example, bench mark your web traffic before your social media plan is in place, then measure your monthly web traffic after the plan?has been implemented?to gauge whether you have reached the goal of increasing web traffic through social media.

Second, put a plan in place with realistic timelines for defining your goals and strategy:

    • Determining your team (internal and external)
    • Setting up and branding your accounts with Facebook, LinkedIn, Twitter and YouTube
    • Creating your blog
    • Time needed to begin listening and learning about?your targeted online community
    • Creating content like videos, whitepapers, podcasts and more.

Third, ask for the resources you need. You can tap social media consultants to help with getting your strategy in place, train your team and setting up an editorial calendar. It is best that you don?t use outside help for running your social media, since an internal voice of the business will lend credibility to your online presence. The people chosen will need to have a deep knowledge of your customers, industry, products as well as the company. You will want?people with?distinct personalities?that fits the way you want your business portrayed. You will need?people with integrity, curiosity, good communication skills, technologically savvy and a strong work ethic. Choose wisely.

    You must remember this?.

The most important thing to remember when executing this plan, as you do in all your marketing efforts, is to incite a call to action! Drive them to your website, whitepaper, blog, etc. Ask them to participate in some way with your social media through questions, polls?and opinions.

If you write a strong social media plan, and work diligently at creating content and engaging your community, you will find success in social media. It will take time and hard work to create a following, but it will come.

What do you think? ?Did I leave anything out? ?What has been your experience?

Unexpected inaugural moments make history, too

WASHINGTON (AP) ? The inauguration of a U.S. president is traditionally a highly scripted celebration, with seating charts, schedules, dress rehearsals and planning committees that map each moment of the history-making day from start to finish.

    But sometimes the unexpected happens.

A chief justice stumbles while administering the oath. The bitter cold forces the inaugural ceremony to move inside. A president decides to break from tradition and walk with his inauguration parade down Pennsylvania Avenue to the White House.

Here, in a look at recent presidential inaugurals, are some unexpected or otherwise memorable moments:

    _____

    2009

Barack Obama took his place in history as the country's first black president as he was sworn in on Jan. 20, 2009. A crowd that spanned the U.S. Capitol to the Lincoln Memorial witnessed the moment ? a record turnout of about 1.8 million people.

A briefly awkward instance during his oath-taking ceremony caught observers by surprise.

As Chief Justice John Roberts began reciting the first part of the oath, Obama started to repeat the opening line before Roberts finished. Roberts then misplaced a word in the constitutionally required oath.

Instead of saying, "... that I will faithfully execute the office of president of the United States" ? Roberts rearranged the words a bit and said "faithfully" after "president of the United States." Obama started to respond, but abruptly stopped to let Roberts correct the mistake. Roberts started speaking again and put "faithfully" in the right place but left out the word "execute." And then Obama repeated Roberts' original, incorrect version.

The two men finished the oath with smiles, to the cheers of a jubilant crowd.

The White House maintained that Obama was president regardless of the oath flub. Even so, Roberts administered the oath again a day later, perfectly, before a small group of reporters in the White House Map Room.

    _____

    2001

After the contested 2000 election, George W. Bush pledged at his inauguration as the 43rd president to "build a nation of justice and opportunity."

On the inaugural platform with Bush as he took the oath of office that day was his vanquished rival, outgoing Vice President Al Gore, who won the popular vote but fell short in the electoral competition when the battle for Florida ended in the U.S. Supreme Court.

Also standing near Bush during the ceremony was his father, George H.W. Bush, the nation's 41st president. After the oath, the younger Bush hugged his father, who wiped away a tear. The last time the nation had seen an incoming president's father live long enough to attend his son's inauguration was 40 years earlier, when Joseph Kennedy watched the inauguration of President John F. Kennedy in 1961.

    _____

    1993

At his first inauguration Bill Clinton, of Hope, Ark., pressed for change and told the nation that "to renew America, we must be bold."

His inaugural ceremony featured poet Maya Angelou, who also grew up in Arkansas. She read a poem that celebrated America's diversity, one she had written for the occasion ? "On the Pulse of Morning." Angelou was the first poet to read at a presidential inauguration since Robert Frost, who read at John F. Kennedy's swearing-in in 1961.

Later that night, the new president delighted thousands at a packed room at the Arkansas ball, where Clinton played "Your Momma Don't Dance and Your Daddy Don't Rock 'n' Roll" on his trademark saxophone with Ben E. King.

Clinton would take up the sax again and jam with Clarence Clemons, and at another ball with Herbie Hancock and Thelonius Monk.

    _____

    1989

George H.W. Bush was inaugurated on the 200th anniversary of the presidency, and so one of the two Bibles on which he rested his hand during the oath was the same Bible that George Washington used in 1789. The other Bible belonged to the Bush family.

Bush opened his inaugural address with a tribute to Ronald Reagan, the man he served as vice president, calling Reagan a "man who had earned a lasting place in our hearts ? and in our history."

The day marked the first transition in 60 years when an outgoing president had been succeeded by a member of his own party through an election. It had last happened in 1929, when Herbert Hoover succeeded Calvin Coolidge.

    _____

    1981 and 1985:

With Jimmy Carter looking on, Ronald Reagan took the oath as the nation's 40th president on an unusually warm January day. But what happened minutes later made this Inauguration Day really different ? Iran freed 52 American hostages it had held for 444 days.

A complicated deal worked out in the final weeks of the Carter administration eventually secured their freedom. Reagan, however, announced to the nation that the hostages were on their way home.

Reagan told congressional leaders that some 30 minutes earlier, planes bearing U.S. prisoners left Iranian airspace and "they are now free of Iran." He spoke at the traditional luncheon following the swearing-in.

Four years later, Reagan's second inaugural was remembered for a bitter cold snap. The public ceremony was moved inside, where Reagan delivered his inaugural address to invited guests in the Capitol Rotunda. The traditional parade had to be canceled because of the subfreezing temperatures.

    _____

    1977:

Jimmy Carter wanted a people's inaugural.

So, the newly sworn-in president shunned the customary limousine ride from the Capitol down Pennsylvania Avenue during his parade on Jan. 20, 1977. The program had called for Carter to ride in the limo until the procession of marching bands, floats and others was a couple of blocks away from the executive mansion.

Instead, Carter decided to walk the mile-plus parade route.

First, he strolled hand in hand with his wife, Rosalynn. They smiled and waved to an excited ? and surprised ? crowd.

Then, Carter was joined by his sons, Jack, Chip and Jeff. And later, near the end of the parade route, he was joined by his youngest child, 9-year-old Amy, who walked between her parents, all three holding hands.
