Another Yoda statue, Calif. Star Wars fans may get

SAN ANSELMO, Calif. (AP) ? Star Wars fans might soon have another Yoda statue in the San Francisco Bay area to visit.

Filmmaker George Lucas plans to help build a small park in Marin County that would feature a bronze sculpture of the popular Star Wars character, along with one of Indiana Jones.

Lucas' estate manager, Sarita Patel, said the Yoda statue would be similar to one in San Francisco's Presidio neighborhood. That one ? a full-sized replica of the Jedi sage ? lies atop a fountain outside an arts center where Lucas moved most of his operations in 2005. It has become a big draw for fans.

Lucas applied for a permit Wednesday to demolish a building on the site of the planned park in San Anselmo, the town where he lives, the Marin Independent Journal reported (http://bit.ly/YsKH3u)

He announced over the summer that he planned to donate the land where the building sits to the San Anselmo Chamber of Commerce, and donate the statues for the proposed park. Lucas has since also agreed to pay for the building's demolition.

The chamber hopes to raise $150,000 to $200,000 to create the park.

San Anselmo Town Manager Debra Stutsman said the demolition application, which includes a historical analysis of the building, will be reviewed by the town's Planning Commission and Historical Commission.

The building, as well as a fresco inside, date back to 1945.

Patel said Lucas plans to donate the fresco to the Spanish consulate in San Francisco.

Lucas built his film operation in Marin County and had planned to put up a palatial new digital media production studio there. But he abandoned those plans earlier this year in the face of opposition from neighbors and what he said were delays in the approval process.

Christians left out as Egypt gets draft constitution

CAIRO -- Islamists approved a draft constitution for Egypt early Friday without the participation of liberal and Christian members, seeking to pre-empt a court ruling that could dissolve their panel with a rushed, marathon vote that further inflames the conflict between the opposition and President Mohammed Morsi.

The vote by the constituent assembly advanced a charter with an Islamist bent that rights experts say could give Muslim clerics oversight over legislation and bring restrictions on freedom of speech, women's rights and other liberties.

The draft, which the assembly plans to deliver to the president Saturday, must be put to a nationwide referendum within 30 days. Morsi said Thursday it will be held "soon."

'No place for dictatorship'
Morsi added that the decree halting court challenges to his decisions, which provoked protests and violence from Egyptians fearing a new dictator was emerging less than two years after they ousted Hosni Mubarak, was "for an exceptional stage."

"It will end as soon as the people vote on a constitution," he told state television on Thursday night. "There is no place for dictatorship."

The Islamist-dominated assembly that has been working on the constitution for months raced to pass it, voting article by article on the draft's more than 230 articles for more than 16 hours. The lack of inclusion was on display in the nationally televised gathering: Of the 85 members in attendance, there was not a single Christian and only four women, all Islamists. Many of the men wore beards, the hallmark of Muslim conservatives.

ANALYSIS: Crisis tests Egyptians' constitution

For weeks, liberal, secular and Christian members, already a minority on the 100-member panel, have been withdrawing to protest what they call the Islamists' hijacking of the process.

"This constitution represents the diversity of the Egyptian people. All Egyptians, male and female, will find themselves in this constitution," Essam el-Erian, a representative of the Muslim Brotherhood, declared to the assembly after the last articles were passed just after sunrise Friday.

President Mohammed Morsi recently granted himself unprecedented power, leaving many Egyptians furious. NBC's Richard Engel reports.

"We will implement the work of this constitution to hold in high esteem God's law, which was only ink on paper before, and to protect freedoms that were not previously respected," he said.

The sudden rush to finish came as the latest twist in a week-long crisis pitting Brotherhood veteran Morsi and his Islamist supporters against a mostly secular and liberal opposition and the powerful judiciary. Voting had not been expected for another two months. But the assembly abruptly moved it up in order to pass the draft before Egypt's Supreme Constitutional Court rules on Sunday on whether to dissolve the panel.

"I am saddened to see this come out while Egypt is so divided," Egypt's top reform leader, Nobel Peace laureate Mohamed ElBaradei said, speaking on private Al-Nahar TV. But he predicted the document would not last long. "It will be part of political folklore and will go to the garbage bin of history."

A new opposition bloc led by ElBaradei and other liberals said the assembly had lost its legitimacy.

"It is trying to impose a constitution monopolized by one trend and is the furthest from national consensus, produced in a farcical way," the National Salvation Front said in a statement, read by Waheed Abdel-Meguid, one of the assembly members who withdrew.

Thursday's vote escalates the already bruising confrontation sparked last week when Morsi gave himself near absolute powers by neutralizing the judiciary, the last branch of the state not in his hands. Morsi banned the courts from dissolving the constitutional assembly or the upper house of parliament and from reviewing his own decisions.

In a sign of the divisions, protesters camped out in Cairo's Tahrir Square who were watching the interview chanted against Morsi and raised their shoes in the air in contempt.?

The president's edicts sparked a powerful backlash in one of the worst bouts of turmoil since last year's ouster of autocrat Hosni Mubarak. At least 200,000 people protested in Cairo's Tahrir square earlier this week demanding he rescind the edicts.

Several hundred Egyptian protesters and police faced off again today in central Cairo. NBCNews.com's Dara Brown reports.

Street clashes have already erupted between the two camps in the past week, leaving at least two people dead and hundreds injured. And more violence is possible.

The opposition plans another large protest for Friday, and the Brotherhood has called a similar massive rally for the following day, though they decided to move it from Tahrir to avoid frictions. Bands of youths have been daily battling police on a road leading off the square and close to the U.S. Embassy.

Defiance
The Constitutional Court's announcement that it would rule on the legitimacy of the assembly was in direct defiance of Morsi's edicts. It will also rule Sunday on whether to dissolve the upper house of parliament, which is overwhelmingly held by Islamists. Most of the nation's judges are on indefinite strike to protest the edicts.

It is not clear what would happen to the approved draft if the court dissolves the assembly. The crisis could move out of the realm of legal questions and even more into the more volatile street, to be decided by which side can bring the most support.

The opposition is considering whether to call for a boycott of any referendum on the constitution or to try to rally a "no" vote, said Hamdeen Sabahi, a National Salvation Front leader who ran in this year's presidential race and came in a surprisingly strong third.

"The people should not be made to choose between a dictatorial declaration or a constitution that doesn't represent all the people," he told independent ONTV, referring to Morsi's decrees. "He is pushing Egypt to more division and confrontation."

During Thursday's session, assembly head Hossam al-Ghiryani doggedly pushed the members to finish. When one article received 16 objections, he pointed out that would require postponing the vote 48 hours under the body's rules. "Now I'm taking the vote again," he said, and all but four members dropped their objections. In the session's final hours, several new articles were hastily written up and added to resolve lingering issues.

"We will teach this constitution to our sons," al-Ghiryani told the gathering.

Islamist members of the panel defended the fast tracking. Hussein Ibrahim of the Brotherhood said the draft reflected six months of debate, including input from liberals before they withdrew.

"People want the constitution because they want stability. Go to villages, to poorer areas, people want stability," he said.

Over the past week, about 30 members have pulled out of the assembly, with mainly Islamists brought in to replace some. As a result, every article passed overwhelmingly.

Egypt's president Mohamed Morsi, who had granted himself sweeping new powers that would have made all of his rulings immune to judicial review, is facing continued public outcry despite his decision to soften the decree by limiting those rulings to 'sovereign' matters. NBC's Ayman Mohyeldin reports.

Human Rights Watch Rights groups criticized the hurried manner in which the constituent assembly pushed the draft charter through, saying it not the right way to guarantee fundamental rights or the rule of law.

"Rushing through a draft while serious concerns about key rights protections remain unaddressed will create huge problems down the road that won't be easy to fix,"said Joe Stork, deputy Middle East and North Africa director for the New York-based group.

The draft largely reflects the conservative vision of the Islamists, with articles that rights activists, liberals and others fear will lead to restrictions on the rights of women and minorities and on civil liberties in general.

'Morals and values'
One article that passed underlined that the state will protect "the true nature of the Egyptian family ... and promote its morals and values," phrasing that suggests the state could prevent anything deemed to undermine the family.

The draft says citizens are equal under the law but an article specifically establishing women's equality was dropped because of disputes over the phrasing.

As in past constitutions, the new draft said the "principles of Islamic law" will be the basis of law.

Previously, the term "principles" allowed wide leeway in interpreting Shariah. But in the draft, a separate new article is added that seeks to define "principles" by pointing to particular theological doctrines and their rules. That could give Islamists the tool for insisting on stricter implementation of rulings of Shariah.

Another new article states that Egypt's most respected Islamic institution, Al-Azhar, must be consulted on any matters related to Shariah, a measure critics fear will lead to oversight of legislation by clerics.

The draft also includes bans on "insulting or defaming all prophets and messengers" or even "insulting humans" ? broad language that analysts warned could be used to crack down on many forms of speech.

It also preserves much of military's immunity from parliamentary scrutiny, putting its budget in the hands of the National Defense Council, which includes the president, the heads of the two houses of parliament and top generals.

The final draft contains historic changes to Egypt's system of government. It limits to eight years the amount of time a president can serve, for example. Mubarak was in power for three decades. It also introduces a degree of oversight over the military establishment - though not enough for critics.

People are lining up for Wii U launch in London

The European Wii U launch is just a few days away, and some have lined up for a midnight launch event in London.

Wii U londonThe Wii U launches in Europe on November 30, just a few days from now. And as expected, the first few people are already in line. A group of Nintendo fans have queued up in London to be one of the first ones to get the new Wii U console.

And it?s a good idea to get in line: Nintendo has said that Wii U supplies in the UK will be limited, and some have estimated that only about 25,000 Wii U consoles will be available on launch day. Several UK retailers have recently said that they could not guarantee Wii U pre-orders.

UK retailer HMV is holding a midnight launch event in London, where the first 100 people will receive a free copy of New Super Mario Bros U and a Wii U goodie bag. But besides the first 100, it?s unclear how many consoles are in stock for those looking to buy one on launch day.

The Wii U sold 400,000 units in North America during its first week on the market. It would have sold more, but inventory was severely limited. The new console launches in Europe on November 30 and in Japan on December 7.

LEGAL PAD: Your Band's Finances, Paying Professionals, & The Law

WHETHER YOU?RE PLAYING AT LOCAL CLUBS OR TOURING THE REGION, NATION, OR BEYOND, paying the professionals who help you along the way is part of the cost of doing business.? But what are the best practices to implement when paying those people?? Here is a quick list for setting up your band?s business and payment plans, with some legal considerations along the way:?Band Banking:

1) Set Up Your Business:? To get a business bank account, your best bet is to establish a formal company ? which is not as complicated as you might think. ? The most popular entity for bands is the Limited Liability Company, often used because they are less complicated to maintain and provide liability protection against you personally. An LLC is coupled with tax advantages less formal than corporations.? LLC requirements vary from state to state, but can often be filed online at the Secretary of State website.? To check out options for forming an LLC where you live, go to www.nolo.com, search ?LLC? and click on your state.

2) Get an Account:? To set up a business bank account, you?ll need a Federal Identification Number (like a Social Security Number, but for your business), which is easy to do and required for a checking account, line of credit etc.? Go to www.irs.gov and click on ?Apply for an EIN? under ?Online Services?.? It only takes a few minutes.? Select the option for obtaining your letter online as a PDF.? Bring this document and your LLC filing to your local bank and they?ll get you set up.

3) Keep it in the Bank:? Once you have your bank account set up, it should be the destination for all revenue earned by your band.? Although most small venues deal in cash, it?s wise to deposit everything in your business bank account before paying for expenses.? Your manager and other business professionals will be paid on a percentage of your gross or net earnings, so a detailed record is key.? Make a record of any expenses you make in the course of your business operations.? For tax purposes, categorize your business expenses (i.e. travel, gear, promo, food, etc.), as this will make itemizing your deductions easier down the road.

How & When to Pay:

When and how much you pay people who work for your band will depend on many factors.? While there are a variety of tradesmen, professionals, and artists that you will hire, they will generally fall into only a few categories:

Servicers: In most circumstances, this will include everyone from your lawyer to your manager to your accountant.? These professionals should be paid out of your bank account like you pay any service provider in your personal life (guitar repair tech, plumber, mechanic).? No special tax forms or employee arrangements will apply (but more on that later).? Simply cut a check from your band?s checking account and keep track of the expense.? Keep in mind that many of these individuals work off a percentage of your income (manager: 15%, agent: 10%, business manager: 5%).? An important consideration is when the fee will be paid to these professionals: monthly, quarterly, semiannually, or ?by-the-gig.?? The more consistent your revenue, the more consistent your payment will be (i.e. if your group plays all year round, setting up a quarterly payment schedule should be easy.? However, if your gigs are sporadic, a more specialized payment structure should be arranged).? No matter what your system, make sure your payment percentage and timeline are committed to in writing at the outset of your business relationship.

Employees/Independent Contractors: Throughout your career, there will be a multitude of individuals who you hire who will be classified in one of two camps:? ?employees? or ?independent contractors.?? The distinction is important because it determines how you pay the individual and includes a variety of tax consequences.? There is a gray area between the two, but the IRS generally looks at three factors to distinguish: behavioral control, financial control and relationship. Employees are told when, where and how to work. Employees have set hours and are paid an hourly wage or salary. On the other hand, independent contractors work on a project-by-project basis, and can take as much time as they need to complete the project for a set fee.? Employees will have vacation days, sick leave, and will likely use equipment or office space provided by your business.? Why are these distinctions important to you?? It?s dollars and cents.? For each employee, your band will have to pay federal payroll taxes, unemployment taxes, deduct applicable state/federal income taxes, and provide tax forms to the federal government.? For an independent contractor, you simply pay what amount is owed and, at year?s end, provide the individual with a tax form called a 1099.? A great example is a photographer.? Hire them for a tour, and they?re probably an independent contractor.? Hire them for an indefinite amount of time, covering your day-to-day (recording, interviews, tours, promotion, leisure time) while providing them with equipment and space to edit, and they?re likely an employee.

Partners: Your ?partners? are your bandmates and, for better or worse, you split what is left over after all the necessary expenses, servicers, and employees/independent contractors are paid.? If done the right way, there should always be a good amount left (at least proportionally) once overhead is paid. ? You can pay the partners directly from your band bank account.? The income will be taxed through your personal income at years end, with each band member filling out an IRS K-1 form.? So who gets what?? As part of your LLC ? as discussed above ? you?ll want to create an ?Operating Agreement,? which is essentially a rule book for the partners to abide by.? An operating agreement lays out an understanding of how money is raised, profits are split and partners bought-out.? Specific to partner payments, make sure to include terms in percentages and timing.? It?s also important to determine what money will be kept in your band?s account to front overhead expenses for the next pay period.

"It's been a family type of year, a down-home type of year," Pitt says. "Mama's [Jolie] worked more. And quite frankly I've really enjoyed it."

Pitt is only a little over a year away from turning 50, and he admits that it's something that he's thinking about. Though he's as successful as ever, Pitt says he's going to start treasuring each moment he has now that he's getting older.

"This is what I think about: 'Okay, you're way over the mid-point [of your life]. You don't know how much time you have left,' " he says. "I want to enjoy this year more than ever."

Serb sentenced for beating in US freed from jail

BELGRADE, Serbia (AP) ? A former Serb college basketball player serving a two-year prison sentence for beating an American into a coma in New York state has been freed about two months early.

Miladin Kovacevic was sentenced by a Serb court for his attack on fellow Binghamton University student Bryan Steinhauer of Brooklyn in 2008 in a barroom brawl.

The Serb's early release Monday is part of a government amnesty including over 1,000 prisoners sentenced for lesser crimes.

After the brawl, Kovacevic jumped bail in the U.S. and fled to Serbia, which refused to extradite him, angering Washington.

The Serb government eventually paid $900,000 (?694,230) to Steinhauer's family as part of an agreement that also included putting Kovacevic on trial in Belgrade.

The Obama administration and Steinhauer's family both called Kovacevic's sentence too lenient.

Patient&#39;s own immune cells may blunt viral therapy for brain cancer

Doctors now use cancer-killing viruses to treat some patients with lethal, fast-growing brain tumors. Clinical trials show that these therapeutic viruses are safe but less effective than expected.

A new study led by researchers at the Ohio State University Comprehensive Cancer Center ? Arthur G. James Cancer Hospital and Richard J. Solove Research Institute (OSUCCC ? James) shows that the reason for this is in part due to the patient's own immune system, which quickly works to eliminate the anticancer virus.

The findings, published in the journal Nature Medicine, show that the body responds to the anticancer virus as it does to an infection. Within hours, specialized immune cells called natural killer (NK) cells move in to eliminate the therapeutic virus in the brain.

The researchers discovered that the NK cells attack the viruses when they express specific molecules on their surface called NKp30 and NKp46. "These receptor molecules enable the NK cells to recognize and destroy the anticancer viruses before the viruses can destroy the tumor," says co-senior author Dr. Michael A. Caligiuri, director of Ohio State's Comprehensive Cancer Center and CEO of the James Cancer Hospital and Solove Research Institute, and a senior author of the study.

"When we blocked those receptors, the virus has more time to work, and mice with these brain tumors live longer. The next step is to block these molecules on NK cells in glioblastoma patients and see if we can improve their outcome," says Caligiuri, who is also the John L. Marakas Nationwide Insurance Enterprise Foundation Chair in Cancer Research. This study of cancer-cell-killing, or oncolytic, viruses is an example of the value of translational research, in which a problem observed during clinical trials is studied in the laboratory to devise a solution.

"In this case, clinical trials of oncolytic viruses proved safe for use in the brain, but we noticed substantial numbers of immune cells in brain tumors after treatment," says senior author and neurosurgeon Dr. E. Antonio Chiocca, who was professor and chair of neurological surgery while at Ohio State University.

"To understand this process, we went back to the laboratory and showed that NK cells rapidly infiltrate tumors in mice that have been treated with the therapeutic virus. These NK cells also signal other inflammatory cells to come in and destroy the cancer-killing virus in the tumor."

The study used an oncolytic herpes simplex virus, human glioblastoma tumor tissue and mouse models, one of which hosted both human glioblastoma cells and human NK cells. Key technical findings include:

  • Replication of the therapeutic virus in tumor cells in an animal model rapidly attracted subsets of NK cells to the tumor site;
  • NK cells in tumors activated other immune cells (i.e., macrophages and microglia) that have both antiviral and anticancer properties;
  • Depletion of NK cells improves the survival of tumor-bearing mice treated with the therapeutic virus;
  • NK cells that destroy virus-infected tumor cells express the NKp30 and NKp46 receptors molecules that recognize the virus.
"Once we identify the molecules on glioblastoma cells that these NK cell receptors bind with, we might be able to use them to identify patients who will be sensitive to this therapy," Caligiuri says.

Ranbaxy recalls generic Lipitor doses

(AP) ? Ranbaxy Pharmaceuticals Inc. has recalled dozens of lots of its generic version of cholesterol drug Lipitor because some may contain tiny glass particles, the latest in a string of manufacturing deficiencies that once led U.S. regulators to bar imports of the Indian company's medicines.

Ranbaxy, a subsidiary of Ranbaxy Laboratories Ltd., India's biggest drugmaker, is operating under increased scrutiny from the U.S. Food and Drug Administration because of quality lapses at multiple Ranbaxy factories over the past several years. The FDA also has alleged the company lied about test results for more than two dozen of its generic drugs several years ago.

On Friday, Ranbaxy posted a notice on its U.S. website, saying it's recalling 10-, 20- and 40-milligram doses of tablets of atorvastatin calcium. That's generic Lipitor, the cholesterol fighter that reigned for years as the world's top-selling drug.

The recall includes 41 lots of the drug, nearly all with 90 pills per bottle, but three lots contain 500 pills per bottle. It's unclear how many bottles are in each lot, but medicine batches typically contain many thousands of pills. The 80-milligram strength tablets are not affected.

Ranbaxy spokesman Chuck Caprariello did not answer questions or provide any additional information beyond the statement on the company's website.

"Ranbaxy is proactively recalling the drug product lots out of an abundance of caution," the website statement read. "This recall is being conducted with the full knowledge of the U.S. FDA."

The company also filed a two-sentence statement with the Bombay Stock Exchange stating Ranbaxy's investigation would be completed within two weeks, but that after that temporary disruption to the U.S. supply, the company expected to resume shipments here.

Patients who've filled a prescription can contact their pharmacy to determine whether it was made by Ranbaxy or another generic drugmaker and, if it's from Ranbaxy, whether it came from a recalled lot.

Ranbaxy's manufacturing deficiencies, dating to 2006, led to a lengthy investigation and sanctions by the FDA. During the probe, federal investigators found Ranbaxy didn't properly test the shelf life and other safety factors of its drugs and then lied about the results.

In mid-2008, the FDA barred Ranbaxy from shipping into the U.S more than 30 different drugs made at factories in India. Meanwhile, the U.S. Department of Justice demanded Ranbaxy turn over internal documents, alleging the company lied about ingredients and formulations of some medications.

In early 2009, the FDA said it would not consider any new applications from Ranbaxy to sell in the U.S. any products made at the troubled factories.

As FDA discussions with Ranbaxy continued, it appeared Ranbaxy would lose its shot at a revenue windfall when Lipitor's generic U.S. patent expired last Nov. 30. At the time, Lipitor brought in almost $8 billion a year in U.S. sales.

As often happens when patents first expire, for the first six months only one generic rival could compete with brand-name Lipitor. Ranbaxy had that right, although an authorized generic from Lipitor maker Pfizer Inc. and partner Watson Pharmaceuticals Inc. went on sale on Dec. 1. With competition so limited, the generic prices only declined a bit from brand-name drug's price of about $115 a month ? until several other generics entered the market six months later.

The FDA finally ended the suspense, deciding just before midnight on Nov. 30 to let Ranbaxy sell generic Lipitor made at the company's Ohm Laboratories factory in central New Jersey. It was unclear Friday whether the recalled Ranbaxy pills were made there or elsewhere.

Meanwhile, Ranbaxy is operating under a settlement with the FDA, called a consent decree, signed on Dec. 20, 2011. It requires Ranbaxy to improve manufacturing procedures, ensure data on its products is accurate and undergo extra oversight and review by an independent third party for five years. Ranbaxy at the time set aside $500 million to cover potential criminal and civil liability stemming from the Justice Department investigation.

Syria says Turkey's bid for NATO missiles "provocative"

BEIRUT (Reuters) - Syria on Friday condemned Turkey's request for NATO to deploy Patriot defense missiles near their common border, calling it "provocative", after a spate of fighting there that has raised fears of the Syrian civil war embroiling the wider region.

In the first Syrian response to Ankara's request earlier this week, a ministry source told Syrian state television that Damascus would hold Turkey's prime minister responsible for increasing tensions along the frontier.

The 20-month-old uprising against Syrian President Bashar al-Assad has grown increasingly bloody and heavy clashes often erupt right along Syria's northern border with Turkey. Ankara has repeatedly scrambled fighter jets and responded in kind to stray shells flying into its territory.

Turkey's missile request may have riled Damascus and its allies because it could be seen as a first step toward implementing a no-fly zone. Syrian rebels have been requesting one to help them hold territory against a government with overwhelming firepower from the air, but which most foreign governments are loath to impose for fear of getting sucked into the conflict.

The Patriot system is designed to intercept aircraft or missiles. Turkey asked for its deployment after weeks of talks with its NATO allies about how to shore up its 900-km (560 mile) border, where it fears security may deteriorate as the Syrian army steps up fighting against rebel advances.

"Syria stresses its condemnation of the Turkish government's latest provocative step," the ministry source told Syria TV.

The source said that Syria would respect Turkish sovereignty but also said that it "holds (Tayyip) Erdogan responsible for the militarization of the situation on the Syrian-Turkish border and increased tensions".

NATO chief Anders Fogh Rasmussen said on Thursday that the possible deployment of Patriot missiles was "purely defensive" and would "serve as a deterrent to possible enemies even thinking of attacks".

The U.S.-led Western alliance has had some talks on the Turkish request but no decision is expected before next week.

TURKEY REJECTS SYRIAN CRITICISM

Asked about Syria's remarks, Turkish Foreign Minister Ahmet Davutoglu said Damascus was at fault for heightened tensions by having attacked its own people with tanks and warplanes "without any regard for any rules of war".

"There exists such a situation now right next to Turkey, that (Turkey) has to take its own measures...aimed at defense.

"If this measure is not needed then it will not be used, but if there is any kind of risk to Turkey's security, all kinds of steps will be taken, both within Turkey's national capacity and within the framework of Turkey's membership of NATO. Nobody should have a need to question this," Davutoglu added.

Russia, an ally of Assad and Syria's main arms supplier, has opposed the deployment of surface-to-air missiles. It is not a NATO member and cannot block alliance decisions, but planned talks with NATO on Friday about a move it argues "would not foster stability in the region.

Analysts Michael Stephens of the RUSI think-tank in Doha said Turkey's request was a symbolic gesture. He said the Patriot system would do little to stop incoming mortars.

"It could be a first step to a no-fly zone, but what does that take? NATO would need a mandate, which means a United Nations Security Council resolution, and Russia will obviously say no to that," said Stephens.

"This eases the pressure on Erdogan, who may be reluctant to further disrupt the (regional) balance of power. If the missiles are there, it takes the decision out of his hands and puts it on NATO."

DEATH TOLL RISES ABOVE 40,000

With global powers in deadlock over how to defuse Syria's conflict, the number of dead is rising rapidly by the day. The Syrian Observatory for Human Rights said more than 40,000 had died and the number may well be higher because both sides appeared to be under-reporting their casualties.

Erdogan has become a caustic critic of ex-ally Assad but stopped short of serious action to back the insurgents, although he has given them sanctuary on Turkish soil. For its part, Syria has shown few signs of outright aggression towards Turkey.

Rebels appear to have been advancing in recent weeks, seizing several military bases in the eastern Deir al-Zor province, northern Aleppo and even around the capital Damascus.

Their tactics have improved as they focus on controlling roads and choking off military sites. Recent rebel gains in the eastern oil-producing province of Deir al-Zor, including the capture of the Mayadeen artillery base on Thursday, have meant large amounts of weapons and a wider swathe of territory passing into insurgent hands.

But Assad's forces remain in the main city of the province, also called Deir al-Zor, and will be much harder to dislodge.

REBELS STILL LACK FIREPOWER

The insurgents still lack advanced heavy weaponry they need to oust Assad's well-armed troops ensconced in the main cities and remain vulnerable to increasingly frequent air strikes.

Many surface-to-air missiles seized in recent rebel raids appear to be missing some of the equipment needed to fire them, weapons analysts say. This means it is likely the rebels only have the means to fire a few anti-aircraft missiles at a time. Until those capabilities increase, the balance of power may stay the same.

"What you see in Deir al-Zor is a reflection of what is happening everywhere else. The rebels have made big advances in the countryside and even into the main city, but they cannot take it," Stephens said. "This is another brick the rebels have taken down, but it is not critical for toppling the regime."

Deir al-Zor province abuts the long Iraqi border but seizing the frontier may not offer the same advantages seen by rebels near the northern border with Turkey, where the fighters can go in and out easily.

Iraqis are slipping in to fight on both sides. Their loyalties are likely fall along the sectarian lines that have increasingly come to define the Syrian conflict.

Iraq's majority Shi'ite Muslims largely support Assad, whose Alawite minority, derived from Shi'ite Islam, has dominated the country since the president's late father seized power 42 years ago. Sunni Muslims in Iraq generally support the revolt, which is spearheaded by Syria's Sunni majority.

(AP) ? Halle Berry's ex-boyfriend Gabriel Aubry was arrested for investigation of battery Thursday after he and the Oscar-winning actress's current boyfriend got into a fight at her Hollywood Hills home, police said.

Aubry, 37, was booked for investigation of a battery, a misdemeanor, and released on $20,000 bail, according to online jail records. He's scheduled to appear in court Dec. 13.

Aubry came to Berry's house Thanksgiving morning and police responded to a report of an assault, said Los Angeles Police Officer Julie Boyer. Aubry was injured in the altercation and was taken to a hospital where he was treated and released.

Emails sent to Berry's publicist, Meredith O'Sullivan, and Aubry's family law attorney, Gary Fishbein, were not immediately returned.

Berry and Aubry have been involved in a custody dispute involving their 4-year-old daughter, Nahla. The proceedings were sealed because the former couple are not married. Both appeared in the case as recently as Nov. 9, but neither side commented on the outcome of the hearing.

Berry has been dating French actor Olivier Martinez, and he said earlier this year that they are engaged.

Wormholes from centuries-old art prints reveal the history of the 'worms'

By examining art printed from woodblocks spanning five centuries, Blair Hedges, a professor of biology at Penn State University, has identified the species responsible for making the ever-present wormholes in European printed art since the Renaissance. The hole-makers, two species of wood-boring beetles, are widely distributed today, but the "wormhole record," as Hedges calls it, reveals a different pattern in the past, where the two species met along a zone across central Europe like a battle line of two armies. The research, which is the first of its kind to use printed art as a "trace fossil" to precisely date species and to identify their locations, will be published in the journal Biology Letters on 21 November 2012.

Hedges explained that most printed "wormholes" were formed in the carved woodblocks by adult insects and not by the worm-like larvae. After landing on a piece of dry wood, beetles lay their eggs in cracks and crevices. The larvae then spend three to four years burrowing inside the wood, nourishing themselves on the wood's cellulose and growing until they enter the cocoon-like pupal stage when they transform into adults. The adult beetles then burrow straight up toward the surface of the wood, exiting to find a mate and to begin the life cycle anew. "The so-called 'wormholes' found in wood -- including furniture, rafters, oak floors, and woodblocks that were used to print art in books -- are not made by worms as the word suggests; rather, most are 'exit holes' made by those newly transformed adult beetles boring up to the surface and flying away," Hedges said.

When these wormholes were present in an artist's woodblock, they resulted in empty circles within the inked prints made from the woodblock. "These tiny errors or interruptions in the print serve as 'trace fossils,'" Hedges said. "They aren't the animals themselves but they are evidence of the animal's existence. They show that beetles invaded a particular piece of wood, even if that wood no longer exists." Hedges added that studying the prints, rather than the much rarer woodblocks themselves, provides better and more accurate information. A piece of wood can acquire new wormholes throughout the years, and it is difficult to know whether a particular hole was made 10 years ago or many centuries ago. Even a museum specimen that has been protected in recent years could have wormholes from beetles that landed on it just a few years prior to its arrival in the museum.

"By studying printed wormholes, we are seeing only the wormholes that were made at a specific moment in history," Hedges said. "Because most prints, including those in books, have publication dates, we know that the wormholes in question were made very close to that date, or at least between that printing and the first printing. It's an almost perfect biological timestamp. And in most cases, we also know where the book was printed. For example, if printed wormholes appear on a print made in Bamberg, Germany in 1462, then we know that the beetles that made the wormholes in the corresponding woodblock must have lived in or around that place at that time. So wormholes can tell us when and where a species existed with fairly good accuracy, more than 500 years ago, and that is amazing."

Hedges measured the size of more than 3,000 printed wormholes in works of art and books spanning five centuries, from 1462 to 1899. He found that prints from northern Europe -- including England, the Netherlands, Germany, and Sweden -- had holes that were small and round, averaging 1.43 mm in width. However, woodcuts from southern Europe -- including Spain, Portugal, most of France, and Italy -- had larger holes averaging 2.30 mm in width, as well as some unique tracks, including long holes.

"The species that made the wormholes were identified by a process of elimination. For example, the size of the beetle closely matches the size of the hole made, and most species have preferences for the wood they eat. This left two species as the probable hole-makers," Hedges said. "The northern European wormholes most likely were made by the Common Furniture Beetle, Anobium punctatum. The wormholes in southern Europe most likely were made by the Mediterranean Furniture Beetle, Oligomerus ptilinoides." Hedges added that, by comparing the diameters of the wormholes found in art from many different regions of Europe, he was able to determine that the Common Furniture Beetle lived only in a geographic area extending northward from northern France, Switzerland, and Austria, while the Mediterranean Furniture Beetle lived only south of that dividing line. "This is surprising because it means that the two species' ranges were in close contact but, oddly, did not overlap along a precise dividing line," Hedges said. "However, today and for the past 100 years, because travel, shipping, and furniture transport tends to spread insects around, we find both species all over northern and southern Europe and elsewhere in the world." Hedges suspects that the contact zone of the two species across Europe may have been maintained for centuries because of competition for the same food source. All of those details of the species' distribution, including the contact zone, were previously unknown.

Hedges said that this method can be used to study different beetle species in other regions, such as eastern Europe, the Americas, and Asia, and the method even could be used to study earlier time periods. He also predicts that old DNA from the beetles might be recoverable from original woodblocks preserved in museums. "Woodblocks that have been long-preserved in museums have been protected from any recent beetle activity," Hedges explained. "So one exciting possibility would be to examine those woodblocks for traces of DNA from the beetles that made the wormholes, adding a genetic dimension. This research could be done without damaging the rare woodblocks and it would help to confirm identities of the species and their relationships."

Hedges added that his new method has relevance not just to biology, but also to art history. "There are some situations in which a book or print's origin is unknown because a printing location was never added to the text," Hedges said. "Now that we know that different species of beetles existed in different locations in Europe, art historians can determine whether a book was from northern or southern Europe simply by measuring the wormholes."

Wall Street rises after Gaza truce in thin holiday trade

NEW YORK (Reuters) - Stocks advanced on Wednesday after a ceasefire was declared to end the flare-up in violence between Israel and the Palestinians, though the lack of a deal to release aid to Greece kept a lid on gains.

Investors also remained anxious about the tax increases and spending cuts that are poised to come into effect in the new year - known as the "fiscal cliff" - though policymakers are not expected to get back to negotiations until after Thursday's Thanksgiving holiday.

Trading volume was light ahead of Thursday's market holiday. The stock market also will close early at 1 p.m. (1800 GMT) on Friday.

Greece's international lenders failed again to reach a deal to release emergency aid to the debt-saddled country. Lenders will try again next Monday, but Germany signaled that significant divisions remain.

A truce between Israel and Hamas gave stocks some support around midday after Egypt announced a ceasefire will come into effect later in the day.

Fears that the fiscal cliff discussions in Washington could be drawn out or yield no resolution have been at the forefront of investors' minds in recent weeks. Combined with concerns over the euro zone's continued debt problems, the worries had taken more than 5 percent off the S&P 500 since Election Day in early November.

Positive comments from U.S. politicians that they will work to find common ground have helped the S&P 500 recoup some of that loss in recent sessions.

"I think the focus is heavy on what are we doing about fiscal cliff," said Kurt Brunner, portfolio manager at Swarthmore Group in Philadelphia.

"Are these guys talking? Are there going to be substantive decisions made?"

St Jude Medical shares tumbled 13.3 percent to $30.96 after an inspection report from health regulators raised new safety concerns about one of the company's leads that are used with implantable defibrillators, analysts said.

A small gain in International Business Machines helped the Dow outperform the other indexes. IBM was up 0.7 percent at $190.47.

The Dow Jones industrial average <.dji> added 49.35 points, or 0.39 percent, to 12,837.86. The Standard & Poor's 500 Index <.spx> edged up 2.62 points, or 0.19 percent, to 1,390.43. The Nasdaq Composite Index <.ixic> gained 8.28 points, or 0.28 percent, to 2,924.96.

Salesforce.com Inc jumped 7.6 percent to $157.03 after the business software provider beat Wall Street's expectations for the third quarter and maintained its outlook for the rest of the year.

But Deere & Co dragged on the S&P 500 after the world's largest farm equipment maker reported a weaker-than-expected quarterly profit. Its stock lost 4 percent to $82.52.

The market did not derive much direction from the day's economic data, with initial jobless claims falling last week, as expected.

Other data showed manufacturing picked up at its quickest pace in five months in November, while consumer sentiment improved only slightly.

The focus will likely turn to retailers on Friday as analysts try to assess how strong the holiday shopping season will be this year, Brunner said. Holiday shopping traditionally kicks off the day after Thanksgiving, known as Black Friday, as stores offer deals and discounts to lure consumers.
